By accessing or using LuxurAI, you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

Section 01

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Nexinova AI ("LuxurAI", "we", "us", or "our"), governing your access to and use of the LuxurAI platform, including our website at www.luxurai.in, desktop application, and mobile application (collectively, the "Services").

By creating an account, accessing, or using our Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Section 02

Description of Services

LuxurAI provides an AI-powered creative platform offering the following capabilities:

  • Image Generation — AI-powered image creation using our BrainAI model via RunPod infrastructure
  • Video Generation — Short-form video creation powered by HeyGen + ElevenLabs pipeline
  • Coding Assistant — Multi-model AI pipeline (Gemini Leader + DeepSeek + OpenRouter) for code generation, debugging, and review
  • AI Chat — Conversational AI powered by Gemini and other models via the LuxurAI routing system
  • Voice AI — Voice-based interaction features (desktop and mobile app only)

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of Services.

Section 03

User Accounts

To access most features of LuxurAI, you must create an account. You may register using:

  • Magic link authentication (email-based, no password required)
  • Google OAuth sign-in

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] of any unauthorized use of your account.

Account Responsibility: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. LuxurAI reserves the right to suspend or terminate accounts that violate these Terms or provide false information.

We may block, suspend, or permanently ban accounts that engage in abusive behavior, attempt to circumvent billing, or violate our Acceptable Use Policy.

Section 04

Wallet & LC Credits

LuxurAI operates on a credit-based system using "LC" (LuxurAI Credits). All purchases and transactions are subject to the following terms:

  • 1 LC = ₹0.25 base rate (bulk packages available at discounted rates)
  • New accounts receive a signup bonus of 45 LC at no charge
  • LC credits are non-refundable once consumed by a generation
  • Unused LC credits are non-transferable and have no cash value
  • Credit top-ups are processed via Cashfree Payment Gateway
  • All prices are in Indian Rupees (INR) and include applicable taxes
Nature of LC Credits: LC (LuxurAI Credits) represent a limited, non-exclusive, revocable license to access specific AI features on the LuxurAI platform. LC Credits do not constitute personal property, have no intrinsic cash value, and are not a form of currency, financial instrument, or stored value. They confer no ownership rights and no right to a refund except as expressly stated in the Refund Policy below.
Service Lifespan & Credit Validity: Nexinova AI reserves the right to manage, modify, suspend, or permanently eliminate LC Credits at its sole discretion at any time. This includes, without limitation, the right to discontinue the credit-based system entirely, adjust the value or purchasing power of LC Credits, or alter generation costs. LC Credits remain valid only for as long as Nexinova AI chooses to offer and maintain the credit-based service. In the event of company dissolution, acquisition, or a material change in business model, all unused LC balances will be voided without liability or compensation to the User, unless otherwise required by applicable Indian law. Nexinova AI will make reasonable efforts to provide 30 days' advance notice of any such discontinuation where operationally feasible.
Refund Policy: LC credits that have not been used for any generation may be eligible for refund within 7 days of purchase. Refund requests must be submitted to [email protected]. We do not refund credits consumed by completed or partially completed AI generations.

We reserve the right to adjust LC pricing and generation costs with 7 days' notice. Existing purchased credits will be honoured at the rate applicable at time of purchase for 30 days following any price change.

Section 05

Acceptable Use Policy

You agree NOT to use LuxurAI to generate, distribute, or facilitate any content that:

  • Is illegal under Indian law or the laws of your jurisdiction
  • Contains or depicts sexually explicit material, especially involving minors
  • Harasses, threatens, or defames any individual or group
  • Promotes violence, terrorism, or self-harm
  • Infringes upon copyright, trademark, or other intellectual property rights
  • Constitutes misinformation, deepfakes, or non-consensual intimate imagery
  • Attempts to reverse-engineer, scrape, or abuse our API infrastructure
  • Is used for automated bulk generation without explicit written permission
  • Contains malware, viruses, or malicious code (in coding assistant use)
Adversarial Attacks & Jailbreaking: You must not attempt to "jailbreak," perform "prompt injection," use adversarial inputs, or employ any technique designed to bypass, circumvent, or manipulate the safety filters, system prompts, or operational guidelines of our AI models — including LuxurAI Model and Luxur10D. Any attempt to elicit prohibited, harmful, or policy-violating outputs through creative prompt engineering constitutes a violation of these Terms and may result in immediate account termination.
Safety Monitoring: You acknowledge and consent that Nexinova AI uses automated monitoring systems, including AI-powered safety guards, to screen user prompts and model outputs for safety violations, policy breaches, and sensitive data exposure. Flagged content may be reviewed by automated systems. Continued use of the platform constitutes ongoing consent to this monitoring.
Reverse Engineering & Model Distillation: You are strictly prohibited from using LuxurAI outputs, generated content, model responses, or any data obtained through the Services to train, fine-tune, distill, or otherwise develop your own machine learning models or AI systems — particularly any system intended to compete with or replicate the capabilities of LuxurAI, LuxurAI Model, or Luxur10D. This prohibition applies regardless of whether the use is commercial or non-commercial.

Violation of this policy may result in immediate account termination without refund of remaining LC credits. Serious violations may be reported to relevant law enforcement authorities.

Section 06

Intellectual Property

Content generated by LuxurAI using your prompts is subject to the following ownership terms:

  • You retain ownership of the prompts and instructions you provide
  • Generated images and videos are licensed to you for personal and commercial use, subject to the restrictions below
  • Generated content may not be used to train competing AI models
  • LuxurAI retains a non-exclusive license to use generated content for platform improvement

The LuxurAI platform, name, logo, codebase, and all proprietary technology are the exclusive property of Nexinova AI. You may not copy, modify, distribute, or create derivative works based on our platform without written permission.

Section 07

AI-Generated Content

LuxurAI uses third-party AI models including Google Gemini, DeepSeek, and proprietary models via OpenRouter. You acknowledge that:

  • AI-generated content may be inaccurate, incomplete, or inappropriate
  • You are solely responsible for reviewing and validating AI-generated code before use in production
  • LuxurAI does not guarantee the accuracy, legality, or fitness for purpose of any generated content
  • AI models may occasionally produce unexpected or undesired outputs
Code Assistant Disclaimer: The coding assistant is an AI tool designed to assist developers. All generated or modified code should be reviewed by a qualified developer before deployment. LuxurAI accepts no liability for bugs, security vulnerabilities, or damages arising from use of AI-generated code.
Section 08

Training Data Consent

To improve our AI models, LuxurAI may collect anonymized bug→fix pairs from coding assistant sessions. This data collection is:

  • Opt-in only — you control this via the toggle during signup and in Settings
  • Fully anonymized — no personally identifiable information is ever stored
  • Limited to code patterns only — your prompts are stripped of personal context
  • Stored securely on our GitHub repository and/or Hugging Face dataset

You may withdraw consent at any time via Settings → Training Data. Withdrawal does not affect previously collected anonymized data.

Section 09

Termination

Either party may terminate this agreement at any time. You may delete your account via the profile page. Upon termination:

  • Your remaining LC balance will be forfeited (subject to refund policy in Section 04)
  • Your generated content stored on our servers will be deleted within 30 days
  • Your account data will be retained for 90 days for fraud prevention purposes
  • Anonymized training data (if consented) may be retained indefinitely

We reserve the right to terminate accounts immediately for violations of these Terms without prior notice or refund.

Section 10

Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • LuxurAI is provided "as is" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • Our total liability to you shall not exceed the amount you paid us in the 30 days preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for third-party AI model outputs (Google Gemini, DeepSeek, OpenRouter providers)
AI Hallucinations & Accuracy: You acknowledge that AI-generated content is probabilistic in nature and may occasionally be inaccurate, incomplete, biased, outdated, or entirely fictional — a phenomenon commonly referred to as "hallucinations." LuxurAI does not warrant the factual accuracy, completeness, or reliability of any AI-generated output. Users are strictly prohibited from relying on or using LuxurAI outputs for medical diagnosis or treatment decisions, legal advice or proceedings, financial investment decisions, safety-critical systems or infrastructure, or any other context where inaccurate information could cause harm, injury, or significant loss. LuxurAI expressly disclaims all liability for damages arising from reliance on AI-generated content.
Indemnification: You agree to indemnify, defend, and hold harmless Nexinova AI, its founders, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or relating to: (a) your use or misuse of the Services; (b) content you generate, submit, or transmit through the platform; (c) your violation of these Terms; (d) your violation of any third-party rights, including intellectual property or privacy rights; or (e) any claim that your use of the Services caused damage to a third party. This indemnification obligation survives termination of your account and these Terms.

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.

Section 11

Contact & Grievance

For any questions, concerns, or legal notices regarding these Terms:

In accordance with the Information Technology Act, 2000 and rules made thereunder, the name and contact details of our Grievance Officer will be published on our website. Grievances will be addressed within 30 days of receipt.

Updates to These Terms: We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the platform. Continued use of LuxurAI after changes constitutes acceptance of the new Terms.
